McGarvey Law, on behalf of families of patients who died of COVID-19 at Whitefish Care and Rehab Center, have filed a lawsuit in Flathead County. The lawsuit, filed on October 20th, 2020, alleges that negligent treatment of facility residents led to their suffering and death, and a violation of residents’ fundamental right to be treated with human dignity. Thirteen residents of Whitefish Care and Rehab center died of COVID-19 because of the center’s negligence.
The lawsuit alleges that Whitefish Care and Rehab Center failed to establish and maintain a basic and reasonable infection prevention and control program. They concealed their neglect behind COVID-19 restrictions, keeping loved ones and families away from ailing residents, and limiting information that would have revealed the extent of the negligence.
